- sowing the harvested material of a hybrid variety (F1) or a synthetic variety;
- sowing the harvested material of a variety protected with PBR, that belongs to the species not allowed by law to sow as FSS (check the list of allowed species);
- sowing the harvested material of a variety protected with PBR without paying FSS fee to the breeder
In the season of increased demand for seed material, a particularly large number of infringements of the exclusive right result from the activity of the so-called “grey area”, i.e. illegal trade in seed material. Infringements of the exclusive right also include:
- offering or selling for sowing the material of a variety protected with PBR without a written license from the breeder;
- sowing non-certified seed of a variety protected with PBR, purchased e.g. on a marketplace or ads website, or exchanged with a neighbour;
- sowing purchased feed material, consumer material or other not intended for sowing.
