Illegal trade - avoid these transactions!

As the time for preparations for winter sowing approaches and the demand for seed material increases, we remind you that:

  • sowing purchased non-certified seed infringes the exclusive right (PBR) which may result in damages to the Breeder – the holder of PBR to the sown variety
  • offering and selling non-certified seed for sowing purposes also infringes the exclusive right

WARNING: ILLEGAL TRADE! What should you not purchase for sowing?

  • seed from online advertisements or from random sellers at marketplaces (usually such offers are illegal: the seller is not authorized to trade seed material and offers non-certified seed material for sowing)
  • harvested seed from another farmer – so-called neighbour exchange (this also applies to organic farmers)
  • seed from “bargain” offers (suspiciously low prices, bags without official labels, etc.) – often this is seed material from a seed plantation that has not passed the certification process and has not been approved for sale
  • feed, consumption or other non-seed material

LEGAL SALE OF SEED

To legally produce and market seed, a farmer must:

  • have a written license from the Breeder whose variety they wish to sell
  • register with the Plant Health And Seed Inspection (PIORiN) as an entity conducting trade in seed material and report the seed plantation

These formalities are required by the Act on the Legal Protection of Plant Varieties and the Seed Act.
